Indo Projects TERMS AND AGREEMENT

Please read the following terms and conditions fully before using indoprojects.com web site. Freelancers and Project Managers will be referred to as "members".

By registering as a member, you are acknowledging that you have read and agree to all terms and conditions. Indo Projects may terminate the participation of such member in the service and/or may withhold any payments relating to participation in the service due to such member from Indo Projects.

Eligibility Requirements
Indo Projects shall have absolute discretion as to whether or not it accepts a particular applicant or site for participation in the service.

Use of Membership
Your Membership is nontransferable. You agree that only You may use the Membership. Only one membership is allowed per member, however each member may have a Freelancer and Project Manager account. You will promptly notify us if You become aware of any unauthorized use of your Membership. All entrances are recorded. If you give you username and password to anyone else or allow others to enter, your membership will be terminated.

Removal from Network
Indo Projects reserves the right to terminate the participation of any member or site without reason but expressly including any member site that Indo Projects judges to be in violation of the Terms and Conditions.

Members in violation of Indo Projects' Terms and Conditions will be immediately deactivated. Indo Projects may deactivate members with no prior notification, though every effort will be made to notify the deactivated member via the email address provided by the member. Members found in violation of the Terms and Conditions will not receive any credit or payment from Indo Projects. Members that are terminated by Indo Projects on any basis other than violation of these Terms and Conditions will be entitled to receive any payment due from Indo Projects.

Access to Your Account
In order to permit Us to protect the quality of our site and services, You hereby consent to Our employees being able to access Your account and records as necessary to investigate complaints and other allegations or abuse. We shall not disclose the existence or occurrence of such an investigation unless required to by law.

"False" Account Information
Any account with clearly bogus information will be automated deleted by the system. Bogus information includes things such as entering "test" as your first name, "test.com" as your email address, etc.
If you are concerned about your privacy, please note that we adhere to a very comprehensive Privacy Policy - your personal information is not shared with anyone, for any reason. You can view the full Indo Projects Privacy Policy by clicking the link at the bottom of any page of our site.

Unauthorized Use
All of the following will be considered unauthorized use and will be a basis for termination:
1. You may not sell or request copyrighted or illegally licensed material.
2. You may not share your username and password.
3. You may not post your email address or any other contact information (all methods of communication, including phone, ICQ, AIM, MSN Messenger, etc...) on all of Indo Projects part/page/form, etc. except on the "e-mail" field of the signup form and "contact us" form. Any contact outside of Indo Projects before a project has been awarded, will be a basis for termination.
4. You may not avoid commission fees either through contact outside of Indo Projects, bidding any amount other than the total of the project fees (no hourly, each or other abnormal fees), fee negotiations after a project is closed or through the duration of a project posting. Both parties must contact Indo Projects if a project fee is changed. We believe our commissions are very fair and justified for the service we provide, therefore we will absolutely not tolerate any of this activity on Indo Projects.
5. You may not use the Indo Projects message boards for spam, adult material, harassment or any illegal content or activity.
6. You may not provide false or misleading information concerning your identity.
7. You may not use Indo Projects to advertise any URL. All URLs posted on Indo Projects must be related to a project either as a link to your portfolio or resume. All URL must not contain any contact info.

Fees
As consideration for the services you have selected, you agree to pay to us the applicable commission fees through our payment process. All fees payable hereunder are non-refundable. As further consideration for the Services, you agree to: (1) provide certain current, complete and accurate information about you as required by the registration process and (2) maintain and update this information as needed to keep it current, complete and accurate. All such information shall be referred to as account information ("Account Information"). You, by completing and submitting this Agreement represent that the statements in your application are true.

Payment
Indo Projects will pay member via BCA if they requests it AND their account balance is equal to or greater than Rp. 50.000,- . All amounts are stated in and all payments will be made in Rp., Indo Projects reserves the right to suspend a withdrawal if the source of the funds is suspected to be fraudulent. We verify all deposits and might ask you to verify yours; If you refuse to send verification information via E-mail, Fax or Phone, we reserve the right to refund the deposit and terminate your account. Indo Projects reserves the right to suspend a withdrawal if the source of the funds is suspected to be fraudulent.

Referral Comissions
The referral commission paid out will be the one listed on the Referrals Page. If the commission rate is changed, it will only affect referrals made after the new commission was announced. You may not refer yourself, nor sign up for multiple accounts to collect referral fees. You may also not partner with any other Indo Projects user to share/transfer the commission made from your own account, or else both parties will be kicked from the service without payment. Indo Projects reserves the right to delay or cancel sending or retract referral earnings if we believe there's any kind of fraudulent/cheat used.

Denial of Access
The terms of service constitute an agreement that is effective unless and until terminated by Us. If you fail to comply with any term or provision of this Agreement, You agree that We, in our sole discretion, may terminate your access to our Site.

Modification of Terms of Service
We reserve the right to change or modify the terms of service at any time and your continued use of this Site will be conditioned upon the terms of service in force at the time of your use. It is the member's responsibility to check these Terms and Agreement from time to time for such changes.

Copyright & Trademark Notices
You acknowledge that Our Site contains information, software, photos, video, text, graphics, music, sounds or other material (collectively, "content") that are protected by copyrights, patents, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protect in all forms, media and technologies existing now or hereafter developed. No copyright material can be posted on Indo Projects by members. This includes scripts which are sold by the author. Only posting sections of these scripts, as examples, will be permitted. A "section" being no more than 10% of the script's contents. This is meant to protect the author's rights.

Third Party Links
To enhance the value of your Membership, we may display links to websites sponsored by third parties ("Third Party Sites"). If you click on one of these links, you will be taken to a website not controlled by Indo Projects. The Third Party Sites may contain information, affiliate programs or software that is important to the website creation process. Indo Projects is not responsible for the content or operation of Third Party Sites reached by virtue of such links.

Entire Agreement
This Agreement contains all of the Terms of Membership and no representations, inducements, promises or agreements concerning the Membership not included in this Agreement shall be effective or enforceable. If any of the terms of this Agreement shall become invalid or unenforceable, the remaining terms shall not be affected.

Infancy
You attest that you are of legal age to enter into this Agreement.

The Role of Indo Projects
Indo Projects functions as a venue to connect webmasters and programmers in a virtual marketplace. As a neutral facilitator, Indo Projects is not directly involved in the actual transactions between users of the Site. As a result, Indo Projects has no control over the truth, accuracy, quality, legality, or safety of postings made by users. Because verifying the identity of a user on the Internet is difficult, Indo Projects cannot and does not confirm the identity of users. Indo Projects also does not confirm nor verify the qualifications, background, or abilities of users. Therefore, We recommend that You be careful and exercise common sense and good judgment when dealing with any member on the Site. You are enouraged to review our Project Guidelines before taking part in a project. If you are unsatisifed with another member, the most Indo Projects can do is refund the project commission you have been charged by us. We cannot refund the money you have sent to someone, we are not responsible for your transactions. Indo Projects is not responsible for fraudulent payments made by users and cannot be held liable for financial loss incurred from fraudulent transactions. It is the receiver's responsibility to verify the identity and background of the sender.

Any disputes regarding arrangements between Freelancers and Hirers remain solely between Hirers and Freelancers. We are not involved in any transactions between You and any other users of Indo Projects. You acknowledge and agree that Indo Projects will not be a party to any such dispute or be obligated to take any action or refrain from taking any action toward resolving any such dispute. If you have a dispute with any other users of the Site, you hereby release Indo Projects from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, related to such a dispute.
